This website (“Site”) is owned by Bata Primavera Sdn Bhd (“Bata” and together with its parent company and its related entities, affiliates and subsidiaries, the "Group"). We take your (“You”, “User”, “Subscriber”, “Customer”) privacy very seriously and are committed to protecting and respecting your online privacy and recognizing your need for appropriate protection and management of any personal data you share with us. We will use, disclose or otherwise process your personal data in accordance with the Personal Data Protection Act, 2010 (“PDPA”). This Privacy Policy (“Policy”) applies to information supplied by you on this Site. 

 

Other terms used in this Policy shall have the meanings given to them in the PDPA (where the context so permits).

This Privacy Policy applies to all services offered by us and to all individuals whose personal data is collected, processed or stored on our websites, applications or systems, except the services provided on websites, applications or systems that have separate privacy policies that do not incorporate this Privacy Policy. Bata gathers navigational information during your visit to our website. The navigational information tells Bata about the use of our website by visitors, including the areas of our site that are most visited or the time of a last visit to a page and the technical efficiencies of our website and services. We will not share your personal data with any other organization other than related companies and those third parties directly related to the delivery of the products you have purchased from BATA website and as is necessary to process credit or debit card payments. BATA is committed to complying with your right to privacy and the Data Protection Act. 

 

We will not sell and/or share your personal data to any third party without your permission, but we cannot be responsible or held liable for the actions of third-party sites from which you may have linked or been directed to the Bata website. 

 

However, as a part of providing, you with our services and products and the management and/or operation of the same, Bata may be required or need to disclose information about you to BSO as well as the third parties. we may also be under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of; or to protect the rights, property, or safety of Bata, our customers, or others. This includes exchanging information with other companies and organization for the purpose of fraud protection/prevention and/or investigation purposes. 

 

We may pass your name and address on to a third party in order to make delivery of the product to you (for example to our courier). 

 

The sharing of information is subject at all times to any laws (including regulations, guidelines and/or obligations) as may be applicable.

Bata may use your personal data to provide you with information about our and third-party services and/or products, which may be of interest or benefit you, except where otherwise requested by you. In certain instances, we may disclose your relevant personal data to our preferred merchants and strategic partners where your prior consent has been obtained and subject at all times to any laws (including regulations, guidelines and/or obligations) as may be applicable. We take reasonable steps to make sure that our agreements with service providers include appropriate privacy and confidentiality obligations. 

 

All Bata members have the option to opt-out of receiving marketing communications from us and/or selected third parties. If you do not wish to continue to receive marketing communication from us and/or selected third parties, you should inform us via emailing your request to mybata.customerservice@bata.com. We will abide by your latest written instructions to us. 


12. How long We retain Your Personal Data for  


The periods for which We keep your Personal Data depends on the purpose for which your Personal Data was collected. Data containing information provided by you is retained for as long as the purpose for which the data was collected continues. The data is then destroyed unless its retention is required to satisfy legal, regulatory or accounting requirements or to protect Bata's interests, in compliance with relevant regulations. 


13. Security & Protection of Your Personal Data  


We respect your privacy and are committed to protecting the personal data that You provide, in connection with your use of Our site. We take appropriate technical and organizational measures capable of protecting the Personal Data and information against loss, damage, disclosure, replacement with incorrect data or information, or addition of untrue information.  

 

BATA takes the following types of security measures: use of technologies and policies such as limited access data-centres and firewall technology. 

 

The security of your transaction is important to us and to prevent any details being seen by unauthorized persons. It is protected throughout the payment process. To do this, we use 2C2P payment gateway – secured payment site to process your transaction and we do not keep any of your payment information (i.e., Card Number, CSV Code) in our system. 

 

While we implement the above security measures on this site, you should be aware that 100% security is not always possible. 


14. Updating Your Personal Data  


We prefer to keep your personal data accurate and up to date. In order to do this, you can review, update, change or modify your personal data including billing and shipping information by logging into your account on Bata Website. We can assist you to access and correct your personal data held by us. Where you wish to have access to your personal data in Bata’s possession, or where you are of the opinion that such personal data held by us is inaccurate, incomplete, misleading or where irrelevant, not up to date, you may make a request to us via Bata Website. We will use reasonable efforts to comply with your request to access or correct your personal data within reasonable time or as mandated by law. Please note that Bata may have to withhold access to your personal data in certain situations, for example when we are unable to confirm your identity or where information requested for is of a confidential commercial nature or in the event, we receive repeated requests for the same information. Nevertheless, we will notify you of the reasons for not being able to fulfil your request. 


15. Children’s Data 


We understand the importance of protecting children’s privacy and we never knowingly collect personal data about individuals under the age of 18 years. If you are under 18 years of age, consent of a parent / legal guardian is required. In the event we are notified that a minor has provided their personal data without due parent / legal guardian’s consent, we will terminate the account forthwith without prior notice solely at our discretion.

BATA reserves the right to modify and change the Privacy Statement at any time. Any changes to this policy will be published on our site. In absence of any update, the most relevant provisions will be applicable.
