Communication on SC order on EPS on higher wages

In view of the judgment of Hon’ble Supreme Court in case of Employees’ Provident Fund Organisation & Anr. Vs. Sunil Kumar B & Ors and circular issued by the EPFO, the employees who have been member of the pension scheme 1995 as on 31st August, 2014, contributed EPF on actual salary and retired thereafter from the employment of Bata India Ltd are eligible to opt for the higher pension. Bata India Limited has already issued a circular for its existing / former employees to submit Forms and uploaded the same at its website at https://www.bata.in/.

In case the above referred retired employees wish to opt for the higher pension, they may access the circular, Form B while visiting the aforesaid Bata Website and exercise the option as provided therein.

The eligibility and entitlement of the higher pension would be in accordance with the judgment of the Hon’ble Supreme Court, so it is advised to go through the same carefully to figure out their eligibility before exercising the option for higher pension. The above referred former employees of Bata India Ltd are advised to take decision in their own understanding. In case the EPFO rejects their request for any reason whatsoever, they would themselves be required to pursue the same. Bata India Ltd, in any case, being a mere facilitator, will not be responsible for the same.
